Massachusetts Drunk Driving

Massachusetts Drunk Driving Laws are strict and costly if arrested.  In MA you can be arrested for driving for having a BAC (Blood Alcohol Concentration) of .08.  You need to know the consequences.

The legal drinking age in MA is 21; if you are under the legal drinking age and pulled over with a BAC of .02 you will face administrative penalties.  If under the age of 21 and BAC is .08 or higher you will also face standard charges.

You do have the right to refuse a breath analyzer test or a blood test, but you must know that if you do, the police officer can immediately take away your license.

If you are arrested for Massachusetts Drunk Driving you will be prosecuted accordingly.

First Offense

  • Fine: $500 to $5,000
  • Jail: No minimum to 2.5 years
  • Driver’s License Suspension: one year
  • Sentences a first OUI offense can get be reduced by completing a state-approved alcohol education program. This is only for the first offense.

Second Offense

  • Fine: $600 to $10,000
  • Jail: 30 days to 2.5 years
  • Driver’s license suspension: two years

Third Offense (felony)

  • Fine: $1,000 to $15,000
  • Jail: 150 days to five years
  • Suspension: eight years

Fourth Offense (felony)
•    Fine: $1,500 to $25,000
•    Jail: one to five years
•    Suspension: 10 years

Fifth Offense (felony)

  • Fine: $20,000 to $50,000
  • Jail: two to five years
  • Suspension: lifetime

If you are stopped for OUI, in order to minimize the penalties that you can be charged with, it’s extremely important to get legal representation immediately.  You do have the right not have to submit to a field sobriety test, you will have to take a blood or Breathalyzer test.  You can refuse these as well, but a warrant will be issued anyway.  Here again, you should obtain immediately an outside independent test, as sometimes the equipment the police use can be unreliable.  

For these reasons alone, you will want to seek immediate legal consul so that you can take the right and legal steps so that you get all of the legal protection your can for yourself and you assets.  

DUI Laws of MA are very strict and in place so that you do not drink and drive.  Driving under the influence is dangerous to yourself and innocent bystanders.
